Court Decision in Lukwago Vs EC Case Postponed

The expected Court decision in the case filed by Kampala Lord Mayor Erias Lukwago challenging the suspended election campaigns by the Electoral Commission has been pushed to Friday this week.

According to High court Civil Division Registrar Jamson Karemani, the Judge Musa Ssekaana who was supposed to deliver his ruling today, lost a Brother hence the postponement.

Lukwago wants EC Boss Justice Simon Byabakama’s decision quashed and candidates left to freely campaign as provided for under the Constitution or government should declare a State of Emergency due to the prevailing COVID-19 Pandemic.

However EC Lawyers Eric Ssabiti and Hamidu Lugoloobi want Lukwago’s case  dismissed with costs for being premature and lacking merit.

EC says it’s a disguised case seeking revision of Byabakama’s decision that has never been challenged before the Commission as of Section 15 of the EC Act provides.

The EC Lawyers submitted that a dispute had to be first filed with the EC after which Lukwago if dissatisfied would appeal to the High court.
