The High Court in Kampala has condemned the ruling National Resistance Movement (NRM) party for declining to front a flag-bearer for Mawogola North Constituency in Parliament.

This follows a case filed by Aine Godfrey Kaguta Sodo accusing his Party of refusing to endorse him as its official candidate for that Constituency.

Justice Musa Sekaana ruled that the NRM  decision not to front a flag -bearer was illegal and tainted with procedural impropriety; saying the person who made the decision is not the one who heard the complaint against Sodo’s victory in the party primaries.

According to the evidence on Court record, Isaac Kyagaba and Ahmed Kalule Mukasa heard the complaint filed by Sodo’s opponent Shartis Nayebare Kutesa Musherure but a one Enock Barata made and signed the final decisioN which rendered the NRM decision a nullity for breaching the rules of fairness enshrined in the NRM and Uganda’s Constitution.

The Judge however observed that he could not compel NRM to now endorse Sodo as its flag -bearer because Courts cannot substitute an alternative decision in circumstances that have since changed as both Sodo and Shartis are now declared as independent candidates for the said parliamentary seat.

Justice Sekaana has ordered NRM party and Shartis who applied to join the case in support of the party decision to pay costs to Sodo.
