Chinese National Serving 35 Years For Murder Denied Bail on Pre-Hearing

The Supreme Court has denied bail to a Chinese National Wang Nan Noel who was sentenced to 35 years imprisonment for the murder of his Uncle and attempted murder of his Cousin in 2004.

Justice Faith Mwondha dismissed Wang Nan’s application saying the murder offence he committed and was convicted of is grave and involved personal violence.

Now 35 year old Wang Nan Noel who was supposed to suffer death for the brutal murder of Kong Jishu and trying to kill his Cousin Kong Yang in 2013 the Court of Appeal reduced his sentence to 35 years in light of the Susan Kigula Constitutional Petition that declared the death penalty no longer mandatory in Uganda.

He is also appealing this sentence saying its harsh and excessive having served a substantial part of his punishment in Luzira prison.

On 9th October, 2004 at Wandegeya National Housing Construction Corporation (NHCC) Flats, Wang Nan then 19 year old attacked the victims with whom he was staying after they threatened to take him back to China for misbehaving (coming back home late and sleeping out).

Wang Nan is among the 22 Criminal Appeals that another Supreme Court Justice Mike Chibita has presided over today preparing them for hearing in February 2021 after the Elections before a penal of five Justices.

Justice Chibita agreed with the concerned Parties Lawyers to file written submissions in their respective cases by January 2021.

The other appeals to be handled next year is that of former Permanent Secretary Ministry of Local Government John Muhanguzi Kashaka who was sentenced to 10years imprisonment in 2014 for causing government a financial loss of Shs 4.2Bn.

The money was meant to procure over 70,000 bicycles for LC1 Chairpersons.

The appeal of Former Executive Director National Forestry Authority (NFA) Damien Akankwasa who was in 2015 sentenced to 2 years imprisonment; for Abuse of Office after IGG  proved that in 2008 Akankwasa single handedly disposed of 10,000 Eucalyptus poles at Shs 10,000 instead of the Shs 20,000 which was the set price in Mwenge plantation at the time.

And the appeal of former Director of Parliament Budget Office- Samuel Wanyaka Huxley who was in 2015 jailed 10 years for embezzlement of Shs 822M in 2014 before making fictitious and false accountability.

The money was for Services delivery Surveys in the Country.

The convicts from Luzira, Masaka and Masindi Government prisons appeared via video conferencing also installed in the Supreme Court.
