The Civil Division of the High Court in Kampala has directed that the Inspector General of Police (IGP), Director of the Chieftancy of Military Intelligence (CMI), the Commandant Special Forces Command (SFC) and the Attorney General of Government to be notified that the continued detention of a National Resistance Movement (NRM) cadre Bruno Francis Bazibu has come to the Court’s attention and that they shall be required to file a defence.
Bazibu’s application seeking for his unconditional release today came up in Court for hearing but presiding Registrar Jamson Karemani ordered the Family’s Lawyer Lukwago Umar to serve the respondents in this case so that they are made aware that there are legal proceedings instituted against them.
Bazibu’s wife petitioned Court this Week on Wednesday seeking to have her husband who has been missing since 31st October, 2020 released unconditionally by the Security Agents.
This follows unanimous phone calls from the officers holding Bazibu to the family demanding for a ransom of Shs 1Bn.
Fiona Namazzi a resident of Bwebajja along Entebbe road claims that her husband was arrested on the said date by SFC officers while at Okello House in Nakasero where he had gone to attend a meeting.
That since then, her husband has been held in illegal detention for more than 48 hours within which a suspect has to be produced before court.
In her application Namazzi further argues that on 11th November, 2020, SFC Soldiers attached to Kajjansi Police Station conducted a search at their house but still they would not let her see or talk to her husband whom she doesn’t know where he is currently detained.
She says unless Court intervenes and orders the Attorney General to prevail over his servants to release her husband, a violation of personal liberty is at stake.
The hearing of Bazibu’s application for habeaus corpus has been adjourned to Monday 23rd before Justice Emmanuel Baguma.
